Este ensayo, motivado por una crítica de Riccardo Guastini, ilustra el papel de la lógica en el derecho y precisamente: a) en la construcción de la teoría del derecho, b) en el razonamiento y en los discursos desarrollados por las disciplinas jurídicas positivas y c) en los razonamientos y en las operaciones de operadores jurídicos y en particular de los jueces.

Las interpretaciones ascética y vitalista del eidos son incapaces de pensar a fondo su relevancia fenomenológica. Siempre parece que se valora más su perímetro y cerco, al servicio de la clausura y la consolidación de la unidad, que la diversidad intraeidética, infinita o empíricamente abierta. Más allá de lo típico, las rutinas y asentamientos mundanos, la diversidad intraeidética es críticamente eficaz sobre todo en la periferia, al tiempo que propicia la flexibilidad y dilatación interior de cada eidos. Esta problemática es (...) decisiva cuando se trata de pensar la dimensión proteica e hibrida de la cultura humana, así como la posibilidad de diversidad y cordura en un mundo complejo y en expansión.The ascetic and vitalistic interpretations of eidos are unable to think thoroughly its phenomenological relevancy. It always seems that the perimeter and boundary of eidos, at the service of the closure and consolidation of the unity, is more valued than intraeidetic diversity, infinitely or empirically opened. Beyond the typical, mundane routines and settlements, intraeidetic diversity is critically effective especially in the periphery, while enabling the flexibility and inner expansion of each eidos. This problem is crucial when it comes to thinking about the protean and hybrid dimensions of human culture, as well as the possibility of diversity and sanity in a complex and expanding world. Moreover, freedom from duress and coercion, the cardinal rule in research involving adults, is even more important for children. This principle is embodied prominently in the Nuremberg Code (1947) and is embodied in various federal human research protection regulations. In a program named "SATURN" (Student Athletic Testing Using Random Notification), each school (...) in the Oregon public-school system may implement a mandatory drug-testing program for high school student athletes. A prospective study to identify drug use among student-athletes, SATURN is designed both to evaluate the influence of random drug testing and to validate the survey data through identification of individuals who do not report drug use. The enrollment of students in the drug-testing study is a requirement for playing a school sport. In addition to the coercive nature of this study design, there were ethically questionable practices in recruitment, informed consent, and confidentiality. This article concerns the question of whether research can be conducted with high school students in conjunction with a mandatory drug-testing program, while adhering to prevailing ethical standards regarding human-subjects research and specifically the participation of children in research. Partiendo del eje reflexivo que brinda la ambigüedad de la Cultura como atolladero y trascendencia de los individuos, el presente estudio toma dos circunstancias de nuestra situación cultural (hipersubjetividad y superconductividad) como base para una reflexión en torno a las posibles deformaciones del proceso postmoderno de personalización y sobre sus correspondientes enmiendas -mediación densa (resistencia), inspiración (recogimiento) y ruptura de la inmanencia (responsabilidad)-, que puedan reorientar el desarrollo del individuo como Uno entre Otros.

: President Clinton's charge to the Advisory Committee on Human Radiation Experiments included the identification of ethical and legal standards for evaluating government-sponsored radiation experiments conducted during the Cold War. In this paper, we review the traditional account of the history of American research ethics, and then highlight and explain the significance of a number of the Committee's historical findings as they relate to this account. These findings include both the national defense establishment's struggles with legal and insurance issues concerning (...) human experiments, and the medical profession's perspective on human experimentation in the years following the Nuremberg Medical Trials. We conclude that the Committee's work both enriches the traditional view of the history of research ethics and opens important new areas for study. (shrink)

In Amerindian ontologies, hallucinations or visions, rather than being dismissed as delusions or symbolic constructs, are recognized as means of perceptual access to physical reality. Lowland South American shamans claim to be able to diagnose and treat infectious diseases, and to assess the status of wildlife resources through interactions with pathogenic agents perceived in visions. This essay examines some perceptual capabilities that shamans might be employing to explore their physical reality. The structure of the eye affords a form of microscopy (...) of retinal structures and of objects flowing within them, including cells and microbial agents during systemic infection. Lowland South American shamanic practices involve optical and physiological conditions that optimize entoptic microscopy. Images of those visions display the characteristic features of shadow formation, confirming their microscopic origin. This phenomenological access to the microscopic world and similarities with the panorama depicted by current microbiology indicate the commensurability of these forms of knowledge. (shrink)

Relationships between degree/area of academic formation and religious and Darwinian views are controversial. This study aimed to compare the religious beliefs and acceptance of Darwinian evolution between two contrasting South American scientific communities (Chile and Colombia), accounting for different degrees and areas of academic formation. In 2018, 115 last year bachelor students (surveyed as freshmen in 2014 for a previous study) from Chile, and 283 first/last year bachelor students, graduate students, and professors from Colombia, all belonging to biology, chemistry, or (...) physics, were surveyed. Chilean students/faculty were significantly more agnostic/atheist, more accepting of Darwinian evolution, and less creationist than their Colombian counterparts. Academic degree and area differently affected these views in both countries, as only in Chile there was a clear tendency among biologists and physicists with higher degrees to hold less religious and creationist views. Marked differences between the history, socioeconomic contexts, and especially in high school and university curricula of both countries might explain these results. (shrink)

El presente artículo se propone indagar en la praxis de extrañamiento que lleva acabo Gómez de la Serna en El Rastro (1914), praxis que será esencial de cara a comprender uno de los vectores fundamentales de la (ulterior) objetología surrealista. Dicha praxis comprende al menos ocho prácticas o posibilidades de deshacer que afectan al Límite (que discrimina y jerarquiza), al Futuro (ingenuo y dictatorial), a la familiaridad hogareña burguesa (que encarcela y amodorra), a la funcionalidad utilitaria (que banaliza), a la (...) idealidad falsa (de los prestigios de la ciudad), a la propiedad (de nuestras cosas), a uno mismo (praxis de desasimiento), y al propio texto. Estas prácticas configuran un extrañamiento masivo, aunque sereno, con una clara proyección de trascendencia poética, existencial y metafísica. (shrink)

In the digital era, video games have become a major propaganda tool, used for political purposes by state agents and different organisations, including extremist groups. Similarly, some titles have structured their narratives with an educational and awareness-raising purpose, denouncing the senselessness and violence of different terrorist groups. In this article, we will present a general theoretical framework on how video games have been used in the virtual war on terrorism, either in favour of or against it, either by means of (...) special creations or through modifications of famous war games. Next, we will include a case study referring to Spain, analysing the representation in this video game format of the ETA problem or the 11-M jihadist attacks. As a preliminary result, we would like to highlight the importance of this interactive format today, whether from a propaganda, educational or informative point of view. (shrink)

Tras reconocer el papel decisivo que juega en el pensamiento husserliano la intersubjetividad en su estructura trascendental, y, respecto a la Einfühlung y la Fremderfahrung, el importante papel que desempeña la Umfiktion, el presente artículo desarrolla la posibilidad experiencial y de senti-do que supone ese extraño personaje que es la Voz Narrativa heterodiegética. En concreto, la Voz Narrativa como Otro subsidiario en el caso de que los personajes duerman o hayan muerto. Esto permite pensar al Testigo como dativo de manifestación (...) en off en soporte último del continuum de la fenomenalidad. Con ello, se trata de profundizar en la tesis husserliana acerca de la inmortalidad de la subjetividad trascendental y extraer algunas conclusiones metafísicas y éticas. El artículo se basa en un texto de Muñoz Molina en el que comentaba un pasaje de Al faro, de V. Woolf.Recognizing the decisive role in Husserl's thought of the intersubjectivity in its transcendental structure, and, for the Einfühlung and Fremderfahrung, the important role of Umfiktion, this article develops the experiential possibility and the possibility of meaning that assumes the Strange character who is the heterodiegetic Narrative Voice. Specifically, the narrative voice as subsidiary Other in the event that the characters sleep or have died. This suggests the Witness as dative of manifestation in off as last stand of the continuum of phenomenality. With this, it is deepening the Husserlian thesis about the immortality of transcendental subjectivity and draw some metaphysical and ethical conclusions. Specific classes of cyberspaces emphasize different types of digital transactions given the user’s context, thus making it essential to take into account what these environments can afford. In this way, we can portray the niches of technological use as ecologies of particular possibilities and compare how they differ between distinct spheres of human life. The present research is focused on describing the conceptual integration of a taxonomic crossover between Virtual Learning Environments and Educational Affordances of Technology, while also performing empirical (...) testing and determining the psychometric properties in a scale regarding the aforementioned taxonomy. The study sample consisted of 320 students in the departments of foreign languages from three different universities in Sonora. Students were given a questionnaire of 21 items organized into four subscales with a Likert-type response option to measure the notions concerning their usage of Virtual Learning Environments. Internal consistency procedures and confirmatory factor analysis by means of Cronbach’s alpha and Structural modeling support the derived factorial structure, which contains Cyber-Communications, Virtual Behavior Settings, Virtual Communities, and Availability and Access to Connectivity. This structure traces the environmental properties perceived by learners in a virtual environment. Results sustain the initial conceptual construction regarding the proposed taxonomy, conclude that the ‘Virtual Learning Environments Questionnaire’ demonstrates adequate psychometric properties, and validate it as a fitting measure to assess the perceived psychological experience of students in a digital educational setting. People’s concept of free will is often assumed to be incompatible with the deterministic, scientific model of the universe. Indeed, many scholars treat the folk concept of free will as assuming a special form of nondeterministic causation, possibly the notion of uncaused causes. However, little work to date has directly probed individuals’ beliefs about what it means to have free will. The present studies sought to reconstruct this folk concept of free will by asking people to define the concept (Study (...) 1) and by confronting them with a neuroscientific claim that free will is an illusion (Study 2), which invited them to either reconcile or contrast free will with determinism. The results suggest that the core of people’s concept of free will is a choice that fulfills one’s desires and is free from internal or external constraints. No evidence was found for metaphysical assumptions about dualism or indeterminism. (shrink)

According to previous research, threatening people’s belief in free will may undermine moral judgments and behavior. Four studies tested this claim. Study 1 used a Velten technique to threaten people’s belief in free will and found no effects on moral behavior, judgments of blame, and punishment decisions. Study 2 used six different threats to free will and failed to find effects on judgments of blame and wrongness. Study 3 found no effects on moral judgment when manipulating general free will beliefs (...) but found strong effects when manipulating the perceived choice capacity of the judged agent. Study 4 used pretested narratives that varied agents’ apparent free will and found that perceived choice capacity mediated the relationship between free will and blame. These results suggest that people’s general beliefs about whether free will exists have no impact on moral judgments but specific judgments about the agent’s choice capacity do. (shrink)

Moral judgments about an agent's behavior are enmeshed with inferences about the agent's mind. Folk psychology—the system that enables such inferences—therefore lies at the heart of moral judgment. We examine three related folk-psychological concepts that together shape people's judgments of blame: intentionality, choice, and free will. We discuss people's understanding and use of these concepts, address recent findings that challenge the autonomous role of these concepts in moral judgment, and conclude that choice is the fundamental concept of the three, defining (...) the core of folk psychology in moral judgment. In the wake of the most recent tragic school shootings in Florida and Texas, one must ask, when will enough be enough? Mass shootings have become an all-too-normal occurrence in contemporary society in our country. Although we are still impacted by every one of them, there is a concern that we are slowly becoming desensitized to the unspeakable actions of violence that are being carried out regularly. After the initial shock, the typical reaction to such actions involves a clichéd response (...) calling for thoughts and prayers, as if thoughts and prayers were enough to prevent the next incident every other time that people have called for them.
